applicant and the victim and they used to talk with each other from their mobile phones, as disclosed in Paragraph No. 10 of the rejoinder afÏdavit. It is also submitted that in fact on the day of incident, there was marriage of applicant's aunt (Bua) and in the marriage victim and family members also participated and she was talking with the applicant. When her parents saw them together, then some altercation took place between them and both sides lodged F.I.Rs. against each other. On 20.04.2022, F.I.R. was lodged from victim's side at 15:51 hours, whereas from the side of the applicant, F.I.R was lodged on 20.04.2022, at 18:30 hours by the father of applicant against Happy who is cousin of the victim of this case. It is also submitted that before the trial court victim has been examined as PW-1, but she has not supported the prosecution case, thereafter, she has been declared hostile at the request of the prosecution, therefore, there is bleak chance of conviction of applicant, who is languishing in jail since 25.04.2022 having no criminal history to his credit.
