of time, the accused herein had abducted the victim and after constant effort, she was traced. However, again on 26.7.2022 at 10:00 O'clock in the night itself, the coaccused being Shri Jageshwar Yadav son of Shri Surendra Yadav along with two unnamed persons armed with stick, iron rods and pointed objects came to the house, administered the threat and took away the daughter of informant. The informant was not present there and thereafter he met the co-accused Yadav then he could find out that there was certain obseen photographs of the victim which gave an apprehension that the victim was meted with bad act. Learned Counsel for the applicant submits that only on the basis of suspicion, applicant has been falsely implicated in the present case. Learned Counsel for the applicant while drawing attention towards the settlement under Section 161 of the Cr.P.C. which has contended that the victim had good relations with the applicant and she is staying with the applicant as husband and wife and further she was sitting somewhere then the police caught her and took her in their custody. Learned Counsel for the applicant further submits that none of the sections which have been sought to be attracted are applicable in the eye of law. Learned Counsel for the applicant has further invited the attention of the Court towards Paragraph No. 31 so as to further contend that the applicant is not history sheetor and he is languishing in jail since 18.2.2023. If the applicant is released on bail, he will not misuse the liberty of bail, he be enlarged on bail.
