Heard Mr. Radhey Shyam Yadav, the learned counsel for applicant, the learned A.G.A. for State, Mr. Anant Kumar Tiwari, Advocate holding brief of Mr. Devendra Gupta, the learned counsel for first informant.
At the very outset, the learned counsel for applicant contends that charge-sheet has been submitted against the applicant under the provisions of SC/ST Act and also under Section 376 IPC. He therefore submits that present application for bail be permitted to be withdrawn with liberty to file an appeal in terms of Section 14 A1 of SC/ST Act.
Prayer made by the learned counsel for applicant is not opposed by the learned A.G.A. as well as the learned counsel for first informant.
In view of above, the present application is dismissed as withdrawn with liberty aforesaid.
Certified copy of the bail rejection order shall be returned to the learned counsel for applicant after obtaining photo copy of the same to be kept on record.
