By means of this second bail application under Section 439 of Cr.P.C., applicant, who is involved in Special Session Trial No. 2054 of 2018 (State vs. Phool Singh) arising out of Case Crime No. 43 of 2018, under Sections 363, 366, 376-D of I.P.C., Section 5/6 POCSO Act and Section 3(2)(V) of SC/ST Act, Police Station Mujariya, District Budaun, seeks enlargement on bail during the pendency of trial.

First bail application of the applicant was dismissed for want of prosecution by the coordinate Bench of this Court, vide order dated 22.02.2022, in Criminal Misc. Bail Application No. 39209 of 2018.

Perusal of order-sheet shows that matter is pending since May, 2022.

Earlier on, 31.05.2022, 03.11.2022 and 17.01.2023, matter was taken up, but no one appeared on behalf of the applicant to press this bail application.

Today also, when case called out in revised list, none appears on behalf of the applicant, whereas learned A.G.A. for the State is present but he is also not aware about the present status of the trial of the applicant.

In view of the above, the instant bail application is dismissed for want of prosecution.
