It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. It is further submitted that applicant is a married person aged around 45 years. Complainant/ Victim is a widow lady and engaged in money lending business. The wife of applicant has taken Rs. 8,700/- from the victim. The said amount however increased with interest and on the said issue when complaint demanded to return back the outstanding dues with interest, hot talk was exchanged between the complaint and wife of applicant as a result of which a false first information report came to be lodged against the applicant. It is further submitted that with respect to the aforesaid loan amount, a compromise entered into between wife of the applicant and complainant on 01.03.2023 and the loan amount alongwith interest was paid to the complainant. A true copy of the compromise is annexed as Annexure No.2 to the bail application. It is further submitted that victim herself refused to undergo for her medical examination. It is further submitted that applicant is languishing in jail since 08.04.2023 having no criminal history and that in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
