alongwith co-accused was intercepted by the officers of N.C.B., on the basis of prior information received. On the basis of aforesaid information a team was constituted for taking action in the matter and accordingly the applicant was intercepted and Ganja was recovered from the truck. Applicant is a driver of truck and procured Ganja from Udalgudi, Assam and loaded the same in the truck for its delivery to his counter parts. Recovery proceedings was conducted in accordance with the law. During the proceedings of search and seizure applicant and co-accused put their signature on each and every page of the recovery memo, showing their presence at the place of recovery. Applicant was intercepted by the officers of N.C.B. at about 1 am on 26.04.2021 when applicant and co-accused was sitting inside the aforesaid truck. Being lockdown period public witness could not be procured . After recovery one packet was taken out and small quantity was tested with the help of DD Kit, which answered positive test for Ganja. The applicant and co-accused also confirmed Ganja in the packets. The mandatory provisions of Sections 42, 43, 50, 52, 52(A)(2), 55 and 57, of the NDPS Act are properly complied with. The search was conducted in the presence of Superintendent N.C.B. in compliance of the notification no.1/89. The two accused persons namely Malikhan Singh and Serverey Alam along with the seized ganja as well as relevant documents were produced
