- Heard Sri Tripurari Pal, learned counsel for the applicant and Sri Ravi Kant Kushwaha, learned AGA for the Staterespondent.
- The instant application has been filed seeking release of the applicant on bail in Case Crime No. 109 of 2018, under Sections 302, 420, 468, 471 IPC, Police Station Hasayan, District Hathras during pendency of the trial in the court below.
- FIR of the present case was lodged against the applicant and his wife by his brother and according to the FIR, after getting executed the Will in his favour, applicant alongwith his wife committed the murder of his mother on 26.5.2018 and when he was trying to do the cremation then in the meantime, informant informed the police and police arrived at spot and after taking the dead body of the deceased her post mortem was conducted.
- Learned counsel for the applicant submitted that except the fact that applicant and his wife was residing in the house alongwith the deceased and deceased i.e. the mother was murdered in his house, there is no other evidence against the applicant on record.
