Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 953 of 2022, registered under Sections 413, 414 IPC, Police Station Kotwali, District Fatehpur during pendency of the trial.
It has been contended by learned counsel for the applicant that the applicant is innocent and he has been falsely implicated in the present case. It has been further contended that the applicant is not named in the First Information Report and has been falsely implicated simply because he is the jeweller. The name of the applicant has surfaced in the statement of co-accused who has stated that the stolen jewelleries were sold to the applicant. However, nothing incriminating has been recovered from the applicant. The alleged recovery is a joint recovery. The applicant is ailing person and has certain heart complications. The applicant is in jail since 19.2.2023. It has been lastly contended that there is no other criminal history against the applicant. In case, the applicant is released on bail, he will not misuse the liberty of bail and co-operate in trial.
