Having heard the learned counsel for applicants, the learned A.G.A. for State, upon perusal of material brought on record, evidence, nature and gravity of offence as well as the complicity of applicant, the submissions urged by learned counsel for applicant, and though the charge sheet has been submitted against applicant, therefore, the entire evidence sought to be relied upon by the prosecution against applicant now stands crystalized, no such circumstance could be pointed out by the learned A.G.A. necessitating the custodial arrest of applicant during the course of trial, the judgement of Supreme Court in Sumit Subhaschandra Gangwal (Supra) , the period of incarceration undergone, clean antecedents of applicant, applicant is lady and therefore, entitled to the benefit of provisio to Section 437 Cr.P.C., the case of present applicant being similar to bailed out co-accused Naina Kashyap, the role of co-accused Manmohan Singh is distinguishable from the other two co-accused. the clean antecedents of applicant, period of incarceration undergone, but without making any comment on the merits of the case, the applicant has made out a case for bail.
