It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. The first bail application was rejected by this Court considering the age of the victim to be 16 years. This observation was based upon the transfer certificate of the victim of Class 4th, which is annexed with this bail application. It is submitted that a certificate issued by C.M.O. Bareilly is annexed which is based upon the ossification test of the victim, in which, the age of the victim is determined to be 19 (18) years, therefore, she was not minor at the time of incident. It is submitted that in her statement under Section 161 Cr.P.C. she stated that his father wanted to sell her in Rs.3 lac to one Ritik, therefore, she left her house and accompanied with Asif-present applicant at her own accord. In her statement under Section 164 Cr.P.C. she made allegation of commission of rape afterthought against the applicant. It is further submitted that no injury was found on the person of the victim at the time of her medical examination. The victim was a consenting party.
