Rejoinder affidavit is filed today in court is taken on record.
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the entire record.
The present bail application has been filed on behalf of applicant in Case Crime No. 41 of 2021, under Sections 302, 34 I.P.C., Police Station Kotwali, District Jaunpur, with the prayer to enlarge the applicant on bail.
It is submitted by learned counsel for applicant that informant came after hearing the noise and saw that Amit was holding the hands of his mother and Vishal was assaulting with scissor upon his mother. The investigating officer arrested the applicant along with co-accused and had shown false recovery of scissor on the joint pointing of applicant and co-accused. Learned counsel for applicant lastly submits that applicant is in jail since 02.02.2021 having no criminal history and that in case applicant is enlarged on bail, applicant will not misuse the liberty of bail.
