By means of this application under Section 439 of Cr.P.C., applicant, who is involved in Case Crime No. 0476 of 2021, under Sections 376-D, 323, 324, 452 of I.P.C. and 3/4 POCSO Act, Police Station Nai Mandi, District Muzaffarnagar, seeks enlargement on bail during the pendency of trial.
Perusal of order-sheet shows that matter is pending since May, 2022.
Earlier on, 27.07.2022, following order was passed in this bail application by the coordinate Bench of this Court:
"Learned counsel for the applicant after arguing at some length prays that the matter may be adjourned and may be listed after eight months.
List after eight months.
It is made clear that the matter shall not be treated as tied-up or part heard to this Bench."
Today also, when case called out in revised list, none appears on behalf of the applicant to press this bail application, whereas learned A.G.A. for the State is present.
In view of the above, the instant bail application is dismissed for want of prosecution.
