Heard learned counsel for the applicant, learned AGA and perused the record.

The accused-applicant seeks bail in Case Crime No.72 of 2022 under sections 323, 504, 498-A, 304-B IPC and section 3/4 Dowry Prohibition Act, P.S. Motiganj, District Gonda.

The FIR in question was lodged against the entire family members including the applicant who is the husband alleging that in-laws used to harass and had killed the daughter of the informant.

The counsel for the applicant has drawn my attention to the postmortem report which indicate the cause of death as antemortem hanging and no physical injury marks are seen over the body. The applicant is in custody since 22.04.2022 and even the charge has not been framed.

Considering the materials on record including the postmortem report and the fact that there is no likelihood of the trail being concluded in the near future coupled with the fact that the applicant who is in jail since 22.04.2022 and has no criminal antecedents is entitled for bail. Thus, the bail application is allowed.

Let the applicant Chhathiram Verma Alias Nankan be released on bail in aforesaid first information report number subject to his furnishing a personal bond and two reliable sureties each of the like amount to the satisfaction of the court below concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶14

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶15

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
