The contention of learned counsel for the applicant is that the applicant is an innocent person and he has been falsely implicated in the case and there is a cross FIR in this matter. It is further submitted that it is a case of sudden fight and of indiscriminate firing involving a large number of persons and there is no specific role of the applicant. It is further submitted that the main role of firing has been assigned to co-accused Brajesh, who has been granted bail by the co-ordinate Bench of this Court vide order dated 07.05.2022 in Criminal Misc. Bail Application No.18545 of 2022. It is further submitted that there is no injury on any vital part of the body. It is further submitted that in paragraph-22 of the affidavit, the applicant's criminal history of one case in Case Crime No. 56 of 2022, under Sections 147, 148, 149, 323, 504, 307, 302, 34 IPC, Police Station Jasrathpur, District Etah has been disclosed, in which bail application is pending before the Hon'ble Court. It is further submitted that he is in jail since 06.12.2022 and there is no possibility of the applicant tampering with any evidence and in such circumstances, the applicant is entitled for bail. It is also stated that the applicant will not misuse the liberty of bail and he will fully cooperate in the investigation.
