- Applicant seeks bail in Case Crime No. 50 of 2022, under Sections 302/34 of IPC, Police Station Pilakhua, District Hapur, during the pendency of trial.
- It is submitted by learned counsel for the applicant that similarly placed co-accused person, Kalu @ Abhimanyu has already been enlarged on bail by another Bench of this Court vide order dated 15.09.2022 passed in Criminal Misc. Bail Application No. 28817 of 2022. The applicant is languishing in jail since 3.1.2023, having no criminal history. He further submitted that since the case of the applicant is identical to that of co-accused Kalu @ Abhimanyu, who has already been enlarged on bail, he is also entitled to be enlarged on bail on the ground of parity. Learned counsel has also stated that the main accused is co-accused Suraj.
