Heard Sri Anurag Dubey, learned counsel for the applicant and Dr. S.B. Maurya, learned AGA-I for the State.

The instant bail application has been filed seeking release of the applicant on bail in Case Crime No. 47 of 2023, under Sections 495, 496, 417, 418, 420, 506, 120B IPC, Police Station Kotwali Dehat, District Etah during pendency of the trial.

FIR of the present case was lodged against applicant and seven others and according to the FIR, the marriage of brother of the informant was anyhow performed with one co-accused Anjali and thereafter applicant and other co-accused persons on 06.02.2023 pressurized the informant for Vidai of co-accused Anjali. In the FIR it is further alleged that all the co-accused committed fraud with the informant.

Learned counsel for the applicant submitted that entire allegation made against the applicant in the FIR appears to be false and baseless and no reliance can be placed on such hypothetical version and even if the entire allegations are accepted then also no offence at least against the applicant is made out and applicant has been made accused in the FIR very casually and admittedly he neither received any money nor on his instigation marriage of brother of informant was performed with co-accused Anjali. He next submits that applicant is not having any criminal history and in the present matter he is in jail since 07.02.2023.
