named in the F.I.R. During investigation, complicity of the applicant came into light on 04.04.2022 and the name of other six co-accused persons namely Sumit Chaurasia, Amit Kesharwani, Tejas Chopra, Komal Saraswat, Shubham Khorahi and Shivam @ Nayan came into light on 19.04.2022. Thereafter on their pointing out, dead body of the deceased in putrefied stage was recovered on 21.04.2022. Thereafter inquest proceedings was conducted on 21.04.2022 and post-mortem of the deceased was done on 21.04.2022. The Doctor, who conducted the postmortem, was of the opinion that cause of death could not be ascertained, therefore, viscera was preserved. It is next submitted that after culmination of investigation, charge-sheet has been submitted against the applicant as well as other six co-accused persons namely Komal Saraswat, Sumit Chaurasia @ Atharv Chaurasia, Amit Kesharwani, Shubham Khorahi (Malhotra), Shivam @ Nayan Vaishy and Tejas Chopra @ Bittu, who have been granted bail by the co-ordinate Bench of this Court vide orders dated 11.01.2023, 12.01.2023, 02.02.2023, 24.02.2023 and 25.04.2023 respectively in Criminal Misc. Bail Application Nos. 35207 of 2022, 45492 of 2022, 44990 of 2022, 9076 of 2023, 10524 of 2023 and 10066 of 2023 respectively. So far as the present applicant is concerned, except the evidence of last seen by the brother of deceased, there is no corroborative material against the applicant whereas three prosecution witnesses including the informant (father of the deceased) and brother of the deceased have been examined before the trial court, therefore, the applicant who is languishing in jail since 28.04.2022 may be enlarged on bail. The applicant has criminal history of seven cases which have been explained in paragraph no. 55 to the bail application.
