This is second bail application of the applicant.
The first bail application of the applicant was dismissed for non prosecution by this Court vide order dated 18.11.2021 passed in Criminal Misc. Bail Application No. 29057 of 2021 (Ranjeet Singh Rajbhar vs. State of U.P.).
This second bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant- Ranjeet Singh Rajbhar, seeking enlargement on bail during trial in connection with Case Crime No. 165 of 2020, under Section 147, 148, 149, 504, 307, 302, 120-B I.P.C., registered at Police Station Kotwali, District Ghazipur.
The first information report of the present case was lodged on 22.03.2020 by Vinod Kumar Singh against Shankar Pandey, Priyanshu Singh, Boby Sarkar, Saurabh Singh and one unknown person with the allegation that he is living on rent in the house of Praveen Rai along with his family. His son Anshuman Singh aged about 19 years student of B.Com (Final Year) studying in P.G. College who on 21.03.2020 at about 8 pm went with his friend Raghvendra Pratap Singh, Virat Singh and Satyam Rai on the call of Raghvendra Pratap Singh on phone and they were talking near Roza Baba Majar wherein Satyam a friend of his son who was having an old enmity with Shankar Pandey, Priyanshu Singh, Boby Sarkar, Saurabh Singh and about 10 unknown boys armed with knife, kulhadi, small knife, lathi, danda etc. on many motorcycles reached there all of sudden and started hurling abuses and exhorted to kill him on which the said persons together assaulted Anshuman Singh and Raghvendra Pratap Singh with knife, kulhadi, small knife etc. due to which Anshuman Singh his son died and Raghvendra
