Applicant Sarfaraz, arraigned in Case Crime No. 652 of 2022 of district Sambhal under Sections 363/366/376 IPC, Sections 5/6 POCSO Act and Section 3(2)(v) SC/ST (Prevention of Atrocities) Act, sought enlargement on bail. Defence pleaded false implication by the police; that the applicant was neither named in the Section 161 CrPC statements nor identified in the test identification; that his identity was not established by the medico-legal examination; that the police accounts were mutually contradictory; and parity with a similarly placed co-accused admitted to bail by another Bench of this Court by order dated 16.01.2023.
