1.Learned A.G.A. has filed personal affidavit of Deputy Commissioner of Police, Greater Noida, District Gautam Budh Nagar, which is taken on record.

Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

In pursuance to the order 28.08.2023, the Deputy Commissioner of Police, Greater Noida, District Gautam Budh Nagar, has filed his affidavit, wherein, it has been stated that prosecution witness no. 2 has been produced before the court concerned and their statement has been recorded.

At this stage, learned counsel for the applicant submits that the ends of justice would be served, in case, a direction is issued to the trial court to complete the trial court proceedings in a time bound manner.

Learned A.G.A. for the State has no objection to the aforesaid prayer of the learned counsel for the applicant.

Considering the facts and circumstances of the case, as well as, personal affidavit filed today, the trial court is hereby directed that the trial court shall proceed to conclude the proceeding of Case Crime No. 490 of 2020, under Section 8/20 of the Narcotic Drugs and Psychotropic Substance Act, 1985, P.S. Kasana, District Gautam Budh Nagar, without giving unnecessary adjournments to either of the parties, expeditiously, preferably within a period of 6 months from the date of filing of certified copy of this order.

With the aforesaid observation/direction, the bail application is disposed of.

A copy of this order shall be sent by the Registrar (Compliance) of this Court to the trial court for information and necessary action.
