applicants have no concern with the present matter. It is further submitted that the last seen story made in the F.I.R. is a concocted story and it was not possible for the deceased to go with the accused persons of this case with whom he had some fight only one day before. It is further submitted that in the F.I.R., the allegations have been made in respect of the commission of crime under section 302 IPC, but subsequently the police found that it is a case of suicide, however, the essential ingredients to establish the guilt for an offence under section 306 IPC are completely missing in this case. It is further submitted that there is no suicide note in this matter and there was absolutely no reason for the deceased to commit suicide on account of any fault made by the present applicants. It is further submitted that earlier a criminal misc. writ petition no.9593 of 2023 was filed by the applicant no.1, which was dismissed by this Court vide order dated 18.7.2023. It is further submitted that the said writ petition was filed on 17.6.2023 and the matter was converted from sections 302, 120-B IPC to sections 306, 120-B IPC on 29.4.2023. It is further submitted that as per F.I.R. version, in the night of 28.4.2023, the applicants and other co-accused persons had taken the deceased with them, but the informant of the case and other eyewitnesses do not support this version in their statements under section 161 Cr.P.C. given to the Investigating Officer. It is further submitted that the matter is under investigation wherein the applicants are cooperating with the Investigating Officer of the case and as such, they are entitled for anticipatory bail.
