1. Heard Mr.Satish Trivedi, learned Senior Advocate assisted by Mr.Sheshadri Trivedi, learned counsel for the accused-applicant and learned A.G.A. for the State.

Present application under Section 438 Cr.P.C. has been filed by the applicant in anticipation of his arrest in respect of FIR No.127 of 2022 under Section 7 of the Prevention of Corruption Act, 1988, Police Station Sadar Bazar, District Mathura. 3. The accused-applicant was posted as Area Food Officer. The accused-applicant demanded Rs.52,000/- for giving evasive reply under Right to Information Act and he was asked Rs.10000-15,000/- for restoring fair price shop licensee. He demanded Rs.3,000/- per month for running fair price shop. One video of the accused-applicant went viral demanding bribe from the complainant of aforesaid amount.

Departmental enquiry against the accused-applicant got almost concluded. The accused-applicant has been issued a show cause notice for imposing major penalty after conclusion of the departmental enquiry.

5. Considering the fact that the accused-applicant being a public servant demanded bribe amount, this Court does not find it to be a fit case to enlarge the accused-applicant on anticipatory bail. Therefore, this application for anticipatory bail is hereby rejected . The accused-applicant is granted one week's time to surrender before the trial court and apply for regular bail. In case he surrenders and applies for regular bail within a period of 7 days from today, his bail application shall be considered expeditiously in accordance with law.
