Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present application under Section 438 Cr.P.C. has been filed by the applicant seeking bail in anticipation of his arrest in ST No.56 of 2008, State vs. Bhudev Singh, under Section 409, 420, 467, 468, 471 IPC and Section 13(2) of Prevention of Corruption Act, P.S. Soron District Etah, arising out of Case Crime No.25 of 2007, pending in the court of Additional District and Sessions Judge, Court No.2, Kasganj.

As per the allegations in the FIR, the accused applicant was posted as Clerk-cum-Accountant at relevant time in Etah Rural Bank, Branch Candy, District Etah. He in criminal conspiracy with other bank officials withdrew large amount from 143 accounts of Kisan Credit Card. Total 45.40 lacs rupees was misappropriated allegedly by the accused applicant and other co-accused. The bank in internal inquiry found the involvement of the accused applicant in commission of the offence and thereafter, the First Information Report in question came to be registered under Section 167, 168, 169, 471, 420, 409 IPC at P.S. Soron District Etah. The non bailable warrant has been issued against the accused applicant and the proceedings under Section 82 and 83 CrPC have been undertaken against him.

On the last date of listing of this application on 4.1.2023, the counsel for the accused applicant made a submission that the accused applicant had suffered a brain stroke in the year 2019 and he is still admitted in Metro Hospital, Delhi. He took time to produce latest medical certificate/evidence regarding the accused applicant being admitted in Metro Hospital and receiving treatment.

Today, learned counsel for the accused applicant submits that he has not received any such medical certificate.

Considering the allegations against the accused applicant and

the fact that the proceedings under Section 82 and 83 CrPC have been undertaken against the applicant, this Court does not find it a fit case for anticipatory bail. Therefore, the anticipatory bail application is rejected.
