Heard learned counsel for the applicant and learned A.G.A. for the State.

By means of the present application under Section 483 Cr.P.C., the applicant has sought for a suitable direction to the learned Additional Chief Judicial Magistrate, Auraiya to consider and decide Case No. 496/2022 arising out of Case Crime No. 572/2020, under Section 498-A, 323, 506 of I.P.C. & 3/4 D.P. Act, Police Station Ajitmal, District Auraiya within time stipulated by this Court.

It was submitted by learned counsel for the applicant that applicant has filed a case under Section 498-A, 323, 506 of I.P.C. & 3/4 D.P. Act in the year 2022 but the same has not been decided so far due to which, applicant is suffering irreparable loss. Learned counsel further submits that a direction may be issued to the concerned Court to decide the same within specific time.

Perusal of the order sheet goes to show that the cognizance was taken on 28.03.2022 and thereafter process were issued against accused persons. Accused Madhu Dubey and Shiv Prakash Dubey were granted bail on 05.06.2023 while other accused Rajarshi Dubey was released on interim bail and his bail is pending consideration for disposal.

No useful purpose would be served in keeping the application pending, which is finally disposed off with a direction to Additional Chief Judicial Magistrate, Auraiya to consider and decide the aforesaid case expeditiously, in accordance with law.
