Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.

This application under Section 482 Cr.P.C. has been filed seeking direction to the concerned trial court for early disposal of Criminal Misc. Application No. 122 of 2019, 'Chetna Sharma v. Anoot Kumar Sharma', under Sections 125(3) Cr.P.C., Police Station Sector-49, District Gautam Budh Nagar.

Learned counsel for the applicant submits that the proceedings with respect to maintenance were stayed by a coordinate Bench of this Court by order dated 28.05.2019 passed in Criminal Revision No. 2135 of 2019 (Anoop Kumar Sharma v. State of U.P. and another) . Subsequently, the interim order was vacated vide order dated 22.11.2021, therefore, there is no legal impediment in issuance of a direction upon the court concerned to expedite the matter.

In view of the above, without expressing any opinion on the merits of the case, the present application is finally disposed of with a direction to the concerned trial court to decide aforesaid case in accordance with law, without granting unnecessary adjournments to either of the parties, as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order, if there is no legal impediment.

It is open for the court concerned to take all effective measures, as per law, to ensure the presence of the parties.
