This application under Section 482 Cr.P.C. has been filed challenging the charge-sheet dated 28.07.2021 submitted in Case Crime No. 25 of 2021 under Sections 323, 504, 308 I.P.C., Police Station-Khaga District-Fatehpur, Cognizance Taking Order dated 15.11.2021 passed by Additional Chief Judicial Magistrate, Court No. 01, Fatehpur in Criminal Case No. 24127 of 2021 (State Vs. Om Prakash and others) under Sections 323, 504, 308 I.P.C., Police Station-Khaga District-Fatehpur, as well as entire proceedings of aforementioned criminal case now pending in the Court of Additional Chief Judicial Magistrate, Court No. 01, Fatehpur.

After some arguments, the learned counsel for the applicants wants to withdraw the application with liberty to applicants to file bail application before the court of competent jurisdiction.

In view of the above, present application is disposed of with liberty to applicants to appear before court below and file an appropriate application for bail. In case such an application is filed by applicants, the same shall be decided by court below in the light

of decision rendered in Satender Kumar Antil Vs. Central Bureau of Investigation and another, Special Leave to Appeal (Crl.) No (s) 5191 of 2021 decided on 07.10.2021 .
