Heard learned counsel for the applicant and learned A.G.A. for the State opposite party no.1.
The instant application under Section 482 Cr.P.C. has been filed for a direction to the Court below i.e. Addl. District Judge Court No. 18, Ghaziabad to decide the Sessions Trial No. 131 of 2020 (State Vs. Satpal Yadav and others), arising out of Case Crime No. 993 of 2016, under Sections 392, 447, 448, 436, 427, 504, 506, 411 IPC, Police Station Sihani Gate, District Ghaziabad, pending before him, within a stipulated period.
Admittedly, the case is of the year 2020. It is well settled law that the Court shall not issue direction in a mechanical manner to expedite the case as it creates additional work in the court concerned when oldest cases are pending. In the present case, there are no special circumstances which call for early disposal of the said case. As such, no such direction, as prayed for, can be issued to the court concerned. The present application under Section 482 Cr.P.C. is accordingly dismissed.
