Heard Sri Vijan Rathore, learned counsel for the applicant, Sri Baleshwar Chaturvedi, learned counsel for the Opposite Party No.2 and Sri B.B. Upadhyay, learned counsel for the State and perused the material brought on record.

The present application under Section 482 Cr.P.C. has been filed by the applicant- Keshav Singh with the prayer to allow this application quash the entire criminal proceeding initiated against the applicant, pending in the court of learned Special Judge, E.C. Act, IV, Agra in Complaint Case No. 134 of 2005 (U.P. Power Corporation Vs. Keshav Singh), under Section 135 and 138 of Electricity Supply Act, 2003, Police Station Iradatnagar, District Agra and with a further prayer to stay the further proceedings of the said case.

Learned counsel for the applicant at the very outset states that since offences are compoundable he is ready to settle the matter with the opposite party no.2. He has placed reliance in the case of Suresh Ganpati Halvankar vs. The State of Maharashtra and others in Criminal Appeal No. 156 of 2018 decided on 22.01.2018 and appropriate directions be issued for getting the matter settled with the department.

Learned counsel for the State and learned counsel for the Opposite Party No.2 have no objection to the said proposition.

In view of the submissions of learned counsel for the applicant which are not objected by learned counsel for the Opposite Party No.2 the applicant may approach the concerned authority for settlement of his grievance in view of the judgement of the Apex Court in the case of Suresh Ganpati Halvankar (supra) . The petition is accordingly disposed of.
