Heard Mr. Pravesh Kumar, the learned counsel for applicants and the learned A.G.A. for State.
This application under Section 482 Cr.P.C. has been filed challenging summoning order dated 22.7.2022 passed by Civil Judge (J.D.)/F.T.C., Court No. 2, Bulandshahr in Complaint Case No. 324 of 2021 (Jyoti Vs. Bablu @ Narendra and others), under Sections 323, 354, 506 IPC, P.S. Kakod, District Bulandshahr as well as entire proceedings of aforementioned complaint case, now pending in the Court of Civil Judge (J.D.)/F.T.C., Court No. 2, Bulandshahr.
At the very outset, the learned A.G.A. submits that against the summoning order impugned in present application, applicants have already filed a criminal revision before Court below, which is pending. As such, present application is not maintainable.
When confronted with above, the learned counsel for applicant could not overcome the same.
As a result, present application fails and is liable to be dismissed.
It is, accordingly, dismissed.
