Heard learned counsel for the applicant and learned A.G.A for the State-respondent.

The applicant has preferred the present Application under Section 482 of Code of Criminal Procedure, 1973 for quashing of the summoning order dated 10.08.2020 and the entire proceedings of Case No. 4316 of 2020 (State Vs. Nafees & Another) under Section 420 I.P.C., P.S.-Kwarsi, District- Aligarh as well as the Charge Sheet No. 128 of 2020 dated 22.02.2020, under Section 420 I.P.C. arising out of Case Crime No. 98 of 2020, under Section 420 I.P.C. and to stay the further proceeding in the aforesaid case.

After some arguments, learned counsel for the applicant prays that the applicant be permitted to move appropriate application before the Court concerned as provided under Section 227 of the Cr.P.C.

This prayer has not been opposed by the learned A.G.A.

¶9

Considering the facts and circumstances of the case, the applicant is permitted to appear before the concerned court within 15 days from today and move an application under Section 227 of Cr.P.C. claiming discharge. The concerned court shall after hearing the counsel decide the application on merits, in accordance with law expeditiously.

For a period of 30 days, no coercive action will be taken against the applicant.

With the above observations, this application stands disposed of.
