Heard learned counsel for the applicant, learned A.G.A. for the State, and perused material on record.

This application under Section 482 Cr.P.C. has been filed to stay the proceedings of Criminal Complaint No. 128167 of 2021 (Dr. Anand Kishore Agarwal Vs. Ravindra Nath Pandey) under Section 138 N.I. Act, pending in the court of learned Additional Civil Judge (S.D.), IInd. A.C.J.M. Gorakhpur, during pendency of the Criminal Revision No. 97 of 2022, pending in the court of District and Session Judge, Gorakhpur also to direct the revisional court to decide the application dated 23.01.2023 within stipulated period.

Considering the fact that the trial has remained pending since 2022, without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid application dated 23.01.2023 in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of two months from the date of production of a certified copy of this order before it, if there is no other legal impediment.
