Heard learned counsel for applicant, learned A.G.A. for the State and perused the record.

The present application has been filed by applicant seeking direction to Judicial Magistrate-II, Kanpur Dehat for expeditious disposal of Complaint Case No. 432 of 2019 (Shiva @ Aditi vs. Rahul Kushwaha and another), under Sections 498A, 323 I.P.C. and Section 3/4 D.P. Act, Police Station Kakwan, District Kanpur Nagar within a stipulated period.

It is submitted by learned counsel for applicant that the applicant has filed a complaint in the year 2012 and notices were issued to the opposite parties. The opposite parties have appeared before the court below and have been obtained bail. It is further submitted that on account of delaying tactics adopted by opposite parties, the case could not be proceeded and is pending for disposal since 2012.

Considering the facts and circumstances of the case, the Judicial Magistrate-II, Kanpur Dehat is directed to decide the aforesaid complaint case, expeditiously and preferably within a period of one year from the date of production of certified copy of this order, unless there is any legal impediment.

With the aforesaid directions, the application is disposed of.
