Heard learned counsel for the applicant and learned A.G.A. for the State.

The present 482 Cr.P.C. application has been filed to quash the proceedings of Sessions Trial No. 70 of 2018 arising out of Case Crime No. 183 of 2016, under Sections 370, 342, 506 IPC, Police Station Narahat, District Lalitpur and also to quash the cognizance order dated 24.11.2016 alongwith Non Bailable Warrant dated 20.6.2019 alongwith the order dated 26.9.2022 issuing process under Section 82 & 83 Cr.P.C.

Submission is, the applicant had earlier been enlarged on bail in the year 2018. After participating at the trial for some time, the applicant left for Maharashtra in connection with work. Owing to those reasons and compulsions, the applicant could not appear in the trial proceedings on certain dates. It has resulted in issuance of Non Bailable Warrant. At the same time, applicant regrets his mistake and undertakes to participate in the trial proceedings without any further default.

Having heard learned counsel for parties and having perused the record, it is provided, if the applicant appears before the learned court below within 30 days from today and applies for cancellation of NBW, the learned court below may cancel the NBW subject to compliance by the applicant.

Present application is disposed of accordingly.
