1. Heard Sri Daya Ram Singh Chauhan, learned counsel for the applicant and Sri Kamlesh Kumar Tiwari, learned A.G.A. for the State.
2. The instant application has been filed challenging the summoning order dated 13.02.2023 in the Complaint Case No. 22145 of 2022 (Suresh Yadav vs. Brijesh Chakravarti) u/S 138 Negotiable Instruments Act, P.S.- Doharighat, District- Mau, filed by the opposite party no.2 herein against the applicant for dishonor of cheques issued by the applicants in favour of the opposite party no.2, pending in the court of Addl. Civil Judge, Jr. Divsion, Court No.5/ Judicial Magistrate, Mau.
3. Learned counsel for the applicant do not dispute the issuance of cheques, by him, in discharge of the liability against the opposite party no.2.
4. At this stage, learned counsel for the applicant submits that he ready and willing to compound the offence and seeks to withdraw the instant application.
5. In view of the aforesaid, the instant application is dismissed as withdrawn with liberty as prayed.
