Heard learned counsel for the applicant, learned A.G.A. representing the State and perused the record.
The instant application under Section 482 Cr.P.C. has been preferred by the applicant Satendra, who is accused in this case, seeking direction to the concerned Court below to decide Criminal Case No. 01 of 2023 (State Vs. Satendra and others) arising out of Case Crime No. 843 of 2015, under Sections 323, 325, 504, 506, 452 IPC and Section 3(1)(x) SC/ST Act, Police Station Munderwa, District Basti pending in the Court of Juvenile Justice Board, Basti within stipulated period.
At the outset, learned A.G.A. representing the State pointed out that recently the applicant has been declared juvenile vide order dated 09.08.2023 of the Juvenile Justice Board. Thereafter, his matter has been referred to Juvenile Justice Board and considering the facts of the case, there is no delay in conducting the trial of the applicant, therefore, the relief as sought for by means of this application cannot be granted to the applicant at this stage.
In response, learned counsel for the applicant submits that the applicant does not want to press this application, therefore, the same may be dismissed as not pressed.
Learned A.G.A. has no objection to such prayer of learned counsel for the applicant.
In view of the above, the instant application is dismissed as not pressed.
