Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
It has contended by the learned counsel for the applicant that the FIR of the alleged incident has been lodged against the applicant in the year 2011 and the charge sheet has been filed in this case on 19.7.2012, under sections 420, 467, 468, 504, 506 IPC and the cognizance has been taken on 20.6.2013. The summon has been issued against the applicant for 2.8.2013 but in this case, no witnesses has been examined till date.
The only prayer made by the applicant is that a direction be issued to the Additional Chief Judicial Magistrate, Court No. 5, Ghaziabad to decide the Criminal Case no. 1582 of 2019, (State of U.P. Vs. Severam Kasana) under sections 420, 467, 468, 504, 506 IPC, P.S. Sahibabad, District Ghaziabad within a stipulated period.
Considering the facts of the case, without expressing any opinion on the merits of the applicant's case, this application U/s 482 Cr.P.C. is finally disposed of with a direction to the Additional Chief Judicial Magistrate, Court No. 5, Ghaziabad to decide the Criminal Case no. 1582 of 2019, (State of U.P. Vs. Severam Kasana) under sections 420, 467, 468, 504, 506 IPC, P.S. Sahibabad, District Ghaziabad in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of one year from the date of production of certified copy of this order.If there is no legal impediment.
