Heard learned counsel for the applicant and learned A.G.A. for the State.

By means of the present application under Section 482 Cr.P.C., the applicant has sought for a suitable direction to the Special Judge (Prevention of Corruption Act), Court No. 5, Gorakhpur to decide the proceedings of special session trial no. 01 of 2018, (State v. Shashi Shekhar), under Sections 7/13(1)D r/w 13(2) of Prevention of Corruption Act, P.S. Sarai Lakhansi, District Mau, within time stipulated by this Court, which is pending before the aforesaid court.

It was submitted by learned counsel for the applicant that applicant is the defacto complainant of the aforesaid case and charge-sheet against private respondent was submitted in the year 2016, but only one witness has been examined so far. Learned counsel further submits that a direction may be issued to the concerned court to decide the aforesaid case within specific time frame.

In view of aforesaid, the Special Judge (Prevention of Corruption Act), Court No. 5, Gorakhpur is directed to consider and decide the above-stated case expeditiously, preferably within a period of one year from the date of production of copy of this

order before the court concerned, provided there is no legal impediment.

The instant application under Section 482 Cr.P.C. is disposed of accordingly.
