By means of this application, the applicant has prayed for quashing of the impugned order dated 06.06.2023 passed by the Additional Sessions Judge, Court No. 30, Agra whereby the revision filed by the applicant against the order dated 30.5.2022 passed by the learned Magistrate has been dismissed.
At the outset, learned counsel for the applicant submits that basic order dated 30.5.2022 passed by the learned Magistrate whereby application under Section 156(3) Cr.P.C. moved by the applicant has been rejected, has not been challenged in the present application.
On account of the said defect, the applicant does not want to press this application at this stage, therefore, he may be allowed to withdraw this application with liberty to file fresh application with better particulars.
Learned Additional Government Advocate submits that he has no objection to such prayer.
Accordingly, the instant application is dismissed as not pressed with the aforesaid liberty as prayed.
OfÏce is directed to return the certified copy of the documents to the learned counsel for the applicant after retaining the photocopies thereof on record.
