Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early disposal of Complaint Case No.266 of 2019 (Amit Kumar Tripathi vs. Jafar Ahmad) under Section 138 N.I. Act, Police Station- Dumariaganj, District Siddharth Nagar.

It is submitted by learned counsel for the applicant that the aforesaid matter is pending till date, no final decision has been taken. Prayer has been made to direct the court below to pass appropriate orders expeditiously.

Learned AGA has no objection to the aforesaid prayer as made by learned counsel for the applicant.

In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this application pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved.

Considering the fact and circumstances and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, preferably within a period of four months from the next date fixed in the matter, without granting any unnecessary adjournments to either of the parties, if there is no other legal impediment.
