156(3) Cr.P.C. against respondent no.2 to 5, alleging that applicant has visited the power house at Aonla for electricity connection but the respondent no.5 Mukesh demanded an amount of Rs.10,000/for providing electricity connection and he told that, that amount has to be paid to the officials of UPPCL. The applicant contacted respondent no.2 Manoj Kumar Yadav, Junior Engineer, and respondent no.4 Shiv Kumar Clerk, Electricity Department, Aonla and they have also supported the demand made by respondent no.5 Mukesh. It was further alleged that the applicant has refused to pay the said amount and a quarrel has taken place and that later on a forged checking report no.256 prepared by the respondents and a show cause notice was issued to the applicant showing dues of Rs.93,920/- on his part. It was further alleged that no such checking has taken place and no case of theft of electricity has been registered. The applicant has made a complaint to the Executive Engineer, who has scolded the concerned employees and thereafter, by hatching a conspiracy, the said notice was issued to the applicant. It may be seen that specific allegations of demand of Rs.10,000/- was attributed to the respondent no.5 Mukesh, who is not stated to be a public servant. There is absolutely no allegation against respondent no.2 Ramdas Executive Engineer. Merely, a vague allegation has been made against respondent no.2 Manoj Kumar Yadav and respondent no.4 Shiv Kumar that they have also supported the demand made by the respondent no.5 Mukesh. There are no cogent allegations against the private respondents, so as to disclose a cognizable offence under the provisions of the Prevention of Corruption Act.
