Heard learned counsel for the applicants and learned AGA for the State.

At the very outset, learned counsel for the applicant submits that offence under Section 323 IPC made against the applicant is a compoundable offence, which can be decided/settled by the court below, as such, the court below may be directed to dispose of the proceeding of Criminal Case No.581 of 2018 (State Vs. Subedar Yadav and others) arising out of case crime No.70 of 2017, under Secion 323 IPC, Police Station-Rani Ki Sarai, District-Azamgarh within a fixed time frame.

Learned counsel for the opposite party/AGA has no objection for the same.

Considering the facts and circumstances of this case, this Application is disposed of with a direction to the court below, in case, applicant moves an application/representation before the court below, to decide the pending trial/case referred to above, the concerned trial Court is hereby directed to decide the same expeditiously as possible without granting any unnecessary or unduly adjournments to the parties concerned.

With the aforesaid observations/directions, the Application stands disposed off.

It is made clear that this Court has not adjudicated the claim of the applicants on merits.
