Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.

The present application u/s 482 Cr.P.C. has been filed on behalf of the applicant with prayer to direct the court below to consider and disposed of bail application of the applicant on same day in view of law laid down in the case of Amarawati and Others Vs. State of U.P. 2004 (57) ALR 290 which has been affirmed by Hon'ble Supreme Court in Lal Kamlendra Pratap Singh Vs. State of U.P. 2009 Volume 3 ADJ 322 SC in pursuance of Case No. 3334 of 2020 arising out of Case Crime No. 334 of 2020, under sections 323, 504, 506, 308 I.P.C., Police Station-Kotwali Chhibramau, District Kannauj.

After arguing the matter at some length, learned counsel for the applicant prays for withdrawal of this application with liberty to the applicant to file bail application before the court of competent jurisdiction.

Learned A.G.A. has no objection to such request.

In view of the above, the instant application is disposed of as withdrawn with liberty to the applicant to appear before court concerned and file appropriate application for bail, which shall be decided in the light of the judgment of the Hon'ble Supreme Court in Satender Kumar Antil v. Central Bureau of Investigation and another, Special Leave to Appeal (Crl.) No (s) 5191 of 2021, decided on 07.10.2021.
