The instant application under Section 482 Cr.P.C. has been filed by the applicant to quash/stay the s ummoning order dated 06.01.2022 and entire proceedings of Complaint Case No. 434 of 2021 (Gautam Patel Vs. Kamal and Others), under Sections 392 IPC, Police Station- Musajhag, District- Budaun, pending in the Court of Learned Special Judge (Dacoity Affected Area)/Additional Sessions Judge, Budaun.
It has been prayed by learned counsel for the applicant that the applicant is juvenile and was below 18 years of age at the time of the occurrence.
Let the matter be referred to the concerned Juvenile Justice Board to consider the matter in accordance with law.
