Sri Parvez Alam, Advocate has filed his Vakalatnama on behalf of the opposite party no.2 today, which is taken on record.

Heard learned counsel for the applicants, Sri Parvez Alam, learned counsel for the opposite party no.2 and learned A.G.A. for the State. Perused the records.

The present application under Section 482 Cr.P.C. has been filed with the prayer to quash the entire proceeding of Criminal Case No.235 of 2023 (State Vs. Chandan and others), arising out of Case Crime No. 335 of 2022, under Sections 323, 308, 325 IPC, Police Station Jahanaganj, District Azamgarh, pending in the Court of Judicial Magistrate Court No. 20 Azamgarh as well as summoning order dated 06.02.2023.

After arguing the matter at some length, learned counsel for the applicants submits that he wants to withdraw this application with liberty to the applicants to file their bail application before the Court of competent jurisdiction.

Learned AGA and counsel for the opposite party no. 2 have no objection to such request.

In view of the above, this application is disposed of as withdrawn with liberty to the applicants to appear before court below and file appropriate application for bail, which shall be decided by court below in the light of decision rendered in Satender Kumar Antil Vs. Central Bureau of Investigation and another, Special Leave to Appeal (Crl.) No (s) 5191 of 2021 decided on 07.10.2021.
