This application has been filed seeking to quash the proceedings of Case No. 358 of 2012 (arising out of Case Crime No. 156 of 2010), State v. Jagdish Pandey, under Sections 419, 420, 467, 468 and 471 I.P.C., Police Station - Kotwali, District - Mau, pending before the Court of the Chief Judicial Magistrate, Mau.
The Application under Section 482 No. 10815 of 2012 is pending where the applicant has already challenged the impugned chargesheet and the proceedings that are subject matter of challenge here. This application has been filed on the foot of a compromise filed before the Trial Court dated 08.10.2021. The applicant cannot maintain this application for the same relief, may be on a different ground. It will be open to the applicant to file a supplementary affidavit in the Application under Section 482 No. 10815 of 2012 and urge it as a further ground to quash the proceedings that the parties have compromised.
Subject to the above liberty, this application is dismissed .
A certified copy of the compromise along with the application annexed to this application shall be returned to the learned Counsel for the applicant after retaining xerox copies of the same attested by him.
