A perusal of the report dated 01.04.2023 submitted by the SubDivisional Magistrate, Khatauli, District - Muzaffar Nagar through the learned Sessions Judge, Muzaffar Nagar under his forwarding memo dated 03.04.2023, shows that the Sub-Divisional Magistrate has disposed of the Application under Section 122(1)(b) Cr.P.C. vide order dated 22.11.2022 in the light of the Station House Officer's report dated 21.11.2022. This Court must say, that it is indeed a strange manner of disposition. It is very queer to say the least. This application is, however, limited to the seeking of a decision of the said application, which is over.
No further orders are required to be made in this application.
It is accordingly, consigned to the records.
Let a copy of this order be communicated to the Sub-Divisional Magistrate, Khatuli, District - Muzaffar Nagar, through the learned Sessions Judge, Muzaffar Nagar by the Registrar (Compliance) by Monday i.e. 24.04.2023.
