Ms. Sonu Malik,learned counsel for the applicant and Sri Ramesh Kumar Singh, learned A.G.A. for the State are present.
The present leave to appeal application under Section 378 of Cr.P.C. has been filed to set aside the order dated 22.08.2023 passed by Additional Sessions Judge, Court No. 2, Bijnor in Criminal Appeal No. 48 of 2022 (Mohit Kumar & 2 others Vs. State of U.P. & Another).
After some arguments, learned counsel for the applicant wants to withdraw the application with liberty to file appropriate application/ proceedings before the court of competent jurisdiction.
In view of the above, the present application under Section 378 of Cr.P.C. is dismissed as withdrawn.
Accordingly, the present application under Section 378 is dismissed as withdrawn with the aforesaid liberty.
Office is directed to return the certified copy of the judgment and order and other documents to the counsel for the applicant after retaining the xerox copy of the same.
