Heard Sri Dileep Singh, learned counsel for the petitioner and Sri Hemant Pandey, learned Standing Counsel for the Staterespondent no.1.

Pursuant to the order dated 07.11.2023, Sri Rajesh Tripathi, presently posted as Consolidation Officer, Tehsil Kunda, District Pratapgarh, is present before this Court. He submits that the proceeding of the Case No. 11/21-22 (Sukhnandan versus Kewla) pending under Section 9A(2) of the Consolidation of Holdings Act, has already been completed. He further submits that the argument of the learned counsel for the parties have been heard and the date for delivery of judgment is fixed for 21.11.2023. The Officer present before the Court has rendered unconditional and unqualified apology for the delay caused in completion of the aforesaid proceeding.

Since the grievance of the petitioner in so far as the delay in the completion of the proceeding has now been ventilated, learned counsel for the petitioner submits that he has no objection in case the instant petition is finally disposed of with a direction to the respondent no.1 to finally conclude the matter on 21.11.2023.

Considering the facts and circumstances of the case, the writ petition is finally disposed of with a direction to the Consolidation Officer, Tehsil Kunda, District Pratapgarh (respondent no.1) to conclude the aforesaid proceeding of the Case No.11/21-22 (Sukhnandan versus Kewla), strictly in accordance with law, on the said date fixed i.e. 21.11.2023.

The Officer present before the Court need not to appear unless otherwise.
