Heard learned counsel for the petitioner.
This petition has been filed seeking the following relief:
"i)Issue necessary direction to set aside the impugned order dated 5.4.2023 passed by the Additional District Judge, Court No.11, Aligarh in Misc. Civil Appeal No.65 of 2022: Santosh Kumar Vs. Vishal Kumar and another (Annexure No.1 to the petition).
ii. Issue necessary direction to set aside the impugned order dated 11.8.2022 passed by the Civil Judge (Senior Division), Aligarh in Original Suit No.732 of 2019 (Santosh Kumar Vs. Vishal Kumar and another), by which the application paper no.7-C Under Order 39 Rule 1 and 2 of C.P.C. of plaintiffpetitioner has been rejected (Annexure No.2 to the petition)."
After arguing for some time, learned counsel for the petitioner states that he may be permitted to withdraw this petition as he would like to move the appropriate Court for seeking amendment of the plaint.
This petition is dismissed as withdrawn.
It is always open to the petitioner to file any application as may be advised and as permissible under the law.
