Heard Sri Saksham Agarwal, learned counsel for the petitioner and Ms. Deepshikha, learned Chief Standing Counsel for the respondent nos. 2, 3 & 4.

The present writ petition has been filed seeking the following relief:

"(i) To issue a direction to learned Uttar Pradesh Public Service Tribunal Court, Lucknow (opposite party-1) to decide and dispose of case bearing no. 224 of 2022, Shrikant versus State of Uttar Pradesh & Others filed by the petitioner under Section-4 of Uttar Pradesh Public Service Tribunal act, 1976 as expeditiously as possible preferably within two months.

The case of the petitioner is that the petitioner has filed a claim petition under Section 4 of the Uttar Pradesh Public Service Tribunal Act, 1976 on 25.01.2022 bearing Claim Petition No. 242/2022 (Shrikant versus State of U.P. and others) before the Uttar Pradesh State Public Services Tribunal. The contention of the petitioner is that the pleadings have already been exchanged in the instant case and the case is ripe for final hearing, but due to the delay in disposal of the instant case, the petitioner is suffering hardship as he is not getting the benefit of promotion as has been claimed by him in the aforesaid claim petition. Learned counsel for the petitioner further contends that for one or the other reason, the case has been adjourned and the hearing could not have been taken place. He further contends that a direction may be issued by this Court directing the respondent no.1-State Public Services Tribunal to expeditiously dispose of the matter.

Learned Chief Standing Counsel submits that she has no

objection in case a direction is issued by this Court for expeditious disposal of the aforesaid case.

In view of the aforesaid facts and circumstances of the case, this Court is of the view that no useful purpose would be served in keeping this writ petition pending. Accordingly, this Court deems it appropriate to finally dispose of the present writ petition with a direction to Uttar Pradesh State Public Services Tribunal to expeditiously decide the aforesaid claim petition in accordance with law after affording opportunity of hearing to the parties concerned and without granting unnecessary adjournment to either of the parties.

Accordingly, the present writ petition is disposed of with aforesaid direction.
